These Terms of Service govern your use of https://www.esimtop.com and your purchase of travel eSIM products from eSIM Top, operated by Top Mobile LLC (“eSIM Top,” “we,” “us,” or “our”). By accessing our website or placing an order, you agree to these Terms.

1. Our Services

eSIM Top sells prepaid digital travel eSIM plans. Product availability, included destinations, data allowance, validity period, supported networks, speed and hotspot availability vary by plan and are shown on the relevant product page.

2. Device Compatibility

You are responsible for confirming before purchase that your device supports eSIM technology and is carrier unlocked. Device compatibility can vary by model, country of purchase and carrier. 3. Orders and Digital Delivery

eSIMs are digital products and no physical item is shipped. After payment confirmation, eSIM details, a QR code and/or installation instructions are delivered electronically to the email address provided at checkout. You are responsible for providing an accurate and accessible email address.

Most orders are delivered within minutes, but processing may be delayed by payment review, product availability, system maintenance or fraud-prevention checks. Contact support if you do not receive your order within the delivery period stated on our website.

4. Installation and Activation

Follow the installation instructions supplied with your order. Do not delete an installed eSIM unless our support team instructs you to do so, because some eSIM profiles cannot be downloaded again. Activation rules differ by plan; some plans begin when the eSIM first connects to a supported network, while others may begin on installation or on a specified date. The applicable rule is shown in the product information or delivery instructions.

5. Prices and Payment

Prices and currencies are displayed before checkout. Payments are processed securely by Shopify and the payment methods shown at checkout. Taxes, foreign-exchange fees or card-issuer charges may apply depending on your location and payment provider.

We may correct obvious pricing or product-information errors. If an error affects an order already placed, we will contact you and offer an appropriate correction, replacement or refund.

6. Network Availability and Fair Use

Mobile coverage, speed and service quality depend on local network operators, device capability, location, congestion, building conditions, maintenance and other factors outside our direct control. 5G availability is not guaranteed in every location.

Plans described as unlimited may be subject to a carrier fair-use policy, including speed reductions after a stated amount of high-speed data. Any material fair-use limits known to us are shown on the product page or delivery instructions.

7. Customer Responsibilities

You agree to use our services lawfully and not to misuse, resell, interfere with or attempt to reverse engineer an eSIM profile or related service. You are responsible for selecting the correct destination, travel dates, device and plan, and for following installation and data-roaming instructions.

8. Refunds and Cancellations

Because eSIMs are digital products that can be installed or used shortly after delivery, refund eligibility is limited. Refunds, replacements and cancellations are governed by our Refund Policy at https://www.esimtop.com/policies/refund-policy. Contact support promptly if an eSIM cannot be delivered, installed or used as described.

9. Third-Party Networks and Services

Our eSIM plans rely on third-party mobile network operators and service providers. Their network coverage, maintenance, fair-use rules and technical limitations may affect service. Links to third-party websites are provided for convenience and do not make us responsible for their content or practices.

10. Intellectual Property

The eSIM Top name, website design, text, graphics and other original site content are owned by or licensed to Top Mobile LLC and may not be copied, republished or commercially exploited without permission, except as allowed by applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Top Mobile LLC will not be liable for indirect, incidental, special or consequential losses arising from network outages, device incompatibility, incorrect installation, lost access to an email account, or events outside our reasonable control. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

12. Changes to These Terms

We may update these Terms to reflect changes to our services, business practices or legal requirements. The updated version will be posted on this page with a revised date. Changes do not reduce rights already provided to you by applicable consumer law.

13. Governing Law

These Terms are governed by the laws applicable to Top Mobile LLC in Colorado, United States, without limiting any mandatory consumer protections that apply in your place of residence.
